Have you prepared a Last Will and Testament?

Without one, the courts - and not you, decide what happens to your assets, and even your children in the event of an untimely death. There are numerous resources available to each and every person to create a Last Will and Testament regardless whether there is an attorney available to you or not. There are many choices to consider as well about they type of will you prepare... whether it be a living trust, a living will or a general will.

A 'living will', also called 'will to live', is a type of health directive that covers a course of treatment that is to be taken by caregivers - or in some cases forbidding treatment in the case the individual the will covers becomes incapacitated. As the name suggests, the term "will to live", as opposed to the other terms, tends to emphasize the wish to live as long as possible rather than refusing treatment in the case of serious conditions. A living will allows you to make decisions about future health care needs so your family or the hospital does not make those decisions on your behalf.

A 'will' is specifically for stating who gets the assets, the kids and possessions when you die. Any legal adult can draft their own will without the aid of an attorney. There may be additional requirements such as getting the document notarized and signed, usually by two witnesses that are not the beneficiaries.

A ‘'living trust'’ lets you control the distribution of your estate. You simply transfer ownership of your property and your assets into the trust. In the event of your death, the trustee is the beneficiary and the property will be transferred in a matter of weeks. Once the property has been released to the new owner, the living trust ceases to exist.

You can purchase a ‘'do-it-yourself'’ packet with a quick trip to your local office supply chain such as Office Depot, Staples or Office Max. There are hundreds of online resources in which you can quickly create a will in a few easy steps for a very affordable price. You answer a few easy questions (which in my opinion are not so easy considering the subject matter) and after a review process, the document is shipped to you within a few days.

Do yourself and your family a favor and get a will created today. No one wants the burden of trying to determine what to do in the event of an untimely death.
